Application of the principle of autonomy in the field of death and dying of seniors in the Czech Republic

Diploma thesis "Application of the principle of autonomy in the field of death and dying of seniors in the Czech Republic" primaly deals with issues related to the right to self-determination, human dignity and desires associated with the end of life. It seeks to answer the question of the extent to which the autonomy of the individual can be respected and to participate in end-of-life healthcare decisions through the legal concept of living will, even if the person is in a position that does not allow to express the will. Although this institute is firmly rooted in the legal order of the Czech Republic, awareness of this legal concept is insufficient among the public and rarely used, unlike the Federal Republic of Germany, where the institute is usually applied by seniors. The aim of the work is to reflect the current issues of dying and death from an ethical point of view and provide comprehensive information on the current possibilities of exercising the right to self-determination, which can significantly support the quality of human care in the terminal phase of life.
Feasibility of advance directives in paramedic care

This diploma thesis deals with feasibility of advance directives in the practice of emergency medical services. It explores how two emergency medical services deal with rising public interest in this topic - The Emergency medical service of Central Bohemia Region and of Vysočina Region in Czech Republic. The goal of the thesis is to detect under what circumstances can the EMS (emergency medical services) play a functional role in the practice of patients end-of-life decisions and in situations containing advance directives. Another goal is to make a set of recommendations for the organizations which could potentially help with dealing with advance directives in pre-hospital care. The empirical part of the study is constructed using a case study approach, it analyses organizational tools, documentation, and internal legislation. It is also made using semi structured interviews with the employees of both organizations. All acquired information is then divided under several categories that are profitable for the case study. Criminal liability of a doctor for withdrawal and withholding of a medical treatment

The making of an end of life decision represents worldwide one of the most difficult issues that physicians can be confronted with - not only should it be regarded as consisting of medical and legal aspects, but ethics and moral values are present as well. Furthermore, it shall not be supposed that the economic parameter is negligible, unfortunately even to the contrary. The fact that the decision is often made by physicians under pressure caused by a system of limited resources (and therefore it can not avoid being distorted ) must be kept in mind. At any rate , according to Czech law under which neither assisted suicide nor life termination on the request is allowed, the legality and legitimacy of withdrawal and withholding of medical treatment is based on the argument of informed consent of the patient, advanced directives and the standard of lege artis treatment. These also shall be pleaded as defences in eventual criminal proceedings.

Civil Liability in the Case of Disrespecting a Patient's Advance Directives The aim of this thesis is to analyse and describe the problematic of Civil Liability in the specific case of disrespecting a patient's advance directives by a medical. The institute of Advance Directives was first introduced in the Czech law by the Convention on Human Rights and Biomedicine in 2001 and later by the Law No. 372/2011 Coll., Act on Health Care Provision. Thought the Advance Directives cannot be considered as a new institute in the Czech law, it is hardly ever used in practice. There is no judicature and practical knowledge on the topic of civil liability in this case, and the insecurity causes that doctors do not feel like willing to respect the exceptionally occurring advance directives, because they fear the criminal liability they think that could arise if they did not provide the health care necessary for saving life of their patient. Use of living wills in intensive medicine and palliative care

Living will is a multidisciplinary, ethical-law problem. When applied a legally competent patient as a lay person orders the medical staff as professionals how to treat him or her in case of him/her not being able, temporarily or permanently, to give an informed permission with a treatment or alternatively refuse such treatment. A patient has a right to express his/her wishes concerning a future health care for him/her-self in a time when he/she is no longer capable to decide on his/her own. The living will is a particular kind of an informed consent or decline targeted towards a future event which is to an extent uncertain. The presented thesis consists of two parts which are additionally divided into three chapters. The major aim of the first part is to give a comprehensive explanation of the Living will's position in the legal system of the Czech Republic. This part also analyses the relation of the modification embedded in the the Act on Health Services and Conditions of Their Provision and the Civil Code. The aim of thesis is to create an overview of the holistic concept of domestic palliative care in the context of social work. This overview includes identification of the needs of people in the terminal stage of life and the dilemmas that families face in the final stage of the lives of their loved ones. The individual chapters of this thesis describe the needs of the dying and informal caregivers, and they point out the importance of the family environment for coping with death-related concerns. The qualitative survey carried out via semi-structured interviews includes identification of the needs of the dying and caregivers, the dilemmas of caregivers in making decisions about choosing the form of care for their loved ones, and mapping the awareness of caregivers about the possibilities of social work support.

Criminal law issues related to Advance directives Abstract The aim of this thesis is to describe the recent institute of Advance directives in the Czech legal system and to analyze criminal law issues related with it's aplication. The focus is on medical workers which can get into jeopardy of criminal liability by respecting the Advance directives. Furthermore in this thesis are compared the legislations of Czech republic and the Australian state Queensland conserning Advance directives. Also, key rullings of Australian courts and other common law courts related to the aplicaton of Advance directives are described in this thesis. Descreption methods were aplied to describe each institute and terms close to it, analyzing methods to analyze liability of medical workers and comparative methods to compare the Czech and Queensland legislations.
